Domestic Violence
Domestic violence is physical or verbal abuse against a spouse, former spouse, present or past romantic partner, child, family member or person who lives with you. In California, once the police become involved in a domestic dispute, it is no longer in the hands of the family to decide whether to press charges. It is in the sole discretion of the prosecution to determine whether to press charges. Additionally, the victim may request a temporary restraining order which will prohibit the accused from coming into contact with the victim or their children – possibly even meaning the accused will have to move from the residence that they share with the victim.
California Domestic Violence Penalties
Domestic violence can be charged as a misdemeanor or a felony. This is called a “wobbler,” since the prosecutor may elect which one to file. It is usually charged as a felony when the defendant sexually abused a minor, assaulted a minor, or caused substantial bodily damage to the victim. A misdemeanor is punishable by up to one year in county jail and a felony offense and is punishable by up to 4 years in state prison and/or a fine of up to $6,000. The punishments associated with a domestic violence conviction include, but are not limited to the following:
- Imprisonment in the County Jail or State Prison
- Restitution
- Large Fines
- Community Service
- Probation
- Parole
- Court-Ordered Counseling
If the defendant has a prior criminal offense on his or her record, he or she may be subject to enhanced criminal charges and sentencing if convicted. Due to the life-altering legal consequences that are involved, it is always in a person’s best interest to obtain the services of a criminal defense attorney who has the legal background and knowledge it takes to successfully fight domestic violence charges. Additionally, the court may issue a restraining order, which prohibits you from having any contact with the victim.
